    These Terms of Service ("Terms") govern your use of PixBearer's wedding photo and video collection service ("Service") operated by PixBearer ("we", "us", or "our").

    Acceptance of Terms

    By accessing and using our Service, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to these Terms, you should not use our Service.

    Description of Service

    PixBearer provides a platform that allows wedding hosts to collect photos and videos from their guests. The Service integrates with Google Drive to store uploaded media directly in the host's Google Drive account.

    Key Features:

    • Direct upload to the host's Google Drive
    • QR code and custom event link for guest access
    • Optional guest gallery and live slideshow
    • Import from Drive (Premium) — add photos already in the event's Drive folder, or picked files from elsewhere in your Drive, to the gallery
    • Guestbook with written and voice messages
    • Optional display name guests can add to their uploads
    • Co-host access for shared event management
    • Event management, analytics, rate limiting, and security features

    Billing & Payments

    PixBearer offers a free tier and two one-time paid upgrades — Essentials and Premium. Paid plans are a single charge, not a subscription, and do not renew.

    • One-time purchase: You pay once per upgrade; there are no recurring fees, and your purchased features do not expire.
    • Payment processing: Payments are handled securely by Stripe. We never receive or store your full card details.
    • Pricing & taxes: Prices are shown at checkout. Applicable taxes may be added.
    • Refunds: You may request a refund within 24 hours of purchase by emailing support@pixbearer.com — except once your custom event link has been claimed or your event date has passed, after which the purchase is non-refundable because the service has already been delivered.

    Google Services Integration

    Our Service integrates with Google Drive API and other Google services. By using our Service, you also agree to:

    • Google API Services User Data Policy

    Google API Compliance

    PixBearer's use and transfer of information received from Google APIs adheres to the Google API Services User Data Policy, including the Limited Use requirements.

    Google Drive is a trademark of Google LLC. Use of this trademark is subject to Google Permissions. PixBearer is not affiliated with or endorsed by Google.

    User Accounts and Responsibilities

    Account Registration

    • You must provide accurate and complete information
    • You are responsible for maintaining account security
    • You can create and manage more than one event from a single account
    • Email verification is required

    Acceptable Use

    You agree not to:

    • Upload illegal, harmful, or inappropriate content
    • Violate any applicable laws or regulations
    • Attempt to circumvent rate limits or security measures
    • Interfere with the Service's operation
    • Use the Service for commercial purposes without permission

    Content and Intellectual Property

    Your Content

    • You retain all rights to content you upload
    • You grant us permission to process and transfer your content to Google Drive
    • You are responsible for ensuring you have rights to all uploaded content
    • You must respect the privacy and rights of others in uploaded content

    Our Service

    The PixBearer service, including its design, functionality, and code, is protected by intellectual property laws and remains our property.

    Data and Privacy

    Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

    Data Processing

    • We collect technical data for service operation and security
    • Media files are uploaded directly to your Google Drive
    • We retain logs and analytics data as described in our Privacy Policy
    • You can request data deletion at any time

    Service Availability and Limitations

    Current Limitations

    • Free tier: up to 100 files and 10 GB of total transfer per event; videos up to 2 minutes each
    • Paid plans (Essentials / Premium): unlimited uploads per event, with no video-length limit
    • Per-file limits: images up to 30 MB, videos up to 500 MB
    • Rate limiting for uploads and API calls

    Service Availability

    We strive to maintain high availability but do not guarantee uninterrupted service. We may temporarily suspend the Service for maintenance or updates.

    Disclaimer of Warranties

    THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

    We specifically disclaim all warranties regarding:

    • Service availability or uptime
    • Data integrity or backup
    • Google Drive integration reliability
    • File upload success rates

    Limitation of Liability

    IN NO EVENT SHALL PIXBEARER BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

    Our total liability shall not exceed the amount you paid to us for the Service in the 12 months preceding the claim.

    Indemnification

    You agree to indemnify and hold harmless PixBearer from any claims, damages, or expenses arising from:

    • Your use of the Service
    • Content you upload or share
    • Violation of these Terms
    • Violation of third-party rights

    Termination

    Either party may terminate this agreement at any time:

    • You may delete your account and stop using the Service
    • We may suspend or terminate accounts that violate these Terms
    • We may discontinue the Service with reasonable notice

    Upon termination:

    • Your access to the Service will cease
    • We will delete your account data according to our retention policy
    • Files in your Google Drive will remain unaffected

    Changes to Terms

    We reserve the right to modify these Terms at any time. We will notify users of material changes via email or service notification. Continued use of the Service constitutes acceptance of the modified Terms.

    Governing Law

    These Terms shall be governed by and construed in accordance with the laws of Alberta, Canada, without regard to its conflict of law provisions.
